Parties and Purposes

1. This contract; On the one hand, the one who rents “yachts, gulets, catamarans, boats and all other kinds of sea vessels” (hereinafter referred to as “Customer”) and the one who rents “yachts, gulets, catamarans, boats and all other kinds of sea vessels” (hereinafter referred to as “Customer”) It will be referred to as "V-Go Yachting".) for the purpose of renting "yachts, gulets, catamarans, boats and all other types of sea vehicles" for a certain period of time with start and end dates between. 2. The customer and his/her entourage who make a reservation for any of the holiday boats within V-Go Yachting via our website, by phone or via WhatsApp are deemed to have accepted the following conditions in advance.

3. Violation of any of the following conditions gives V-Go Yachting the right to unilaterally cancel the reservation, ask the customer to leave the holiday boat, not refund the prepayment, deposit, damage fee and/or rental fee received, or demand all unpaid amounts, if any. .

Reservation, Prepayment and Remaining Payments

4. You can pre-book your holiday boat using the reservation form on our website, by phone or via WhatsApp.

5. V-Go Yachting provides feedback to customers after checking capacity and availability by requesting the advertisement number of the holiday boat they want to rent, the number of people and the dates they will rent. After the customer and V-Go Yachting communicate for the rental, V-Go Yachting receives a final confirmation of price and availability from the holiday boat owner. After confirmations are received, V-Go Yachting sends the option and the account number or online payment link to which the payment will be made, to the customer via WhatsApp, for the down payment, which is an average of 30%, for the option period provided by the holiday yacht owners. After the prepayment is made, the customer sends the receipt and e-mail address to V-Go Yachting via WhatsApp. V-Go Yachting finalizes the reservation by sending the reservation form and rental agreement to the customer's e-mail address and WhatsApp line. The remaining payment + damage deposit amounts will be paid to the holiday boat owner in cash upon arrival. If no damage is detected during post-departure damage checks, the damage deposit received at check-in will be refunded to the customer without interruption by the holiday boat owner. (Details regarding the damage deposit are given in Articles 34, 35 and 36.)

6. The reservation form sent to the customer includes the advertisement number of the holiday boat requested by the customer, check-in and check-out dates, amounts to be paid and special notes, if any. The customer is requested to check this information and, if there is an error, to request correction by notifying V-Go Yachting. If no error information is sent to V-Go Yachting by the customer within 1 hour after the reservation form is sent to the customer, it is accepted that there is no error in the information written in the reservation form.

7. If the prepayment is not made online or EFT is made and the receipt is not sent to the V-Go Yachting WhatsApp line until the option period communicated to the customer expires, V-Go Yachting will be able to cancel the pre-reservation without informing the customer and use the right to make another reservation for the holiday boat.

8. 1 week before the check-in date, V-Go Yachting shares the contact information of the holiday boat owner with the customer via WhatsApp and asks the customer to confirm with the holiday boat owner. If V-Go Yachting is not notified of any problem regarding the reservation by the customer and/or the holiday boat owner within 12 hours after the holiday boat owner's number is shared with the customer, it is assumed that there is no error in the reservation. The customer will be able to contact V-Go Yachting for all questions until the contact number of the holiday boat owner is shared with the customer.

Entry - Exit Hours

9. On the reservation starting day, the holiday boat check-in time is generally 14:00 at the earliest and 20:00 at the latest. Check-out time is 10:00 in the morning at the latest. (All our advertisements include the earliest entry and latest departure times for the holiday boat. These hours in the advertisements are valid for the relevant holiday boat. The information provided in the reservation form must be paid attention to.)

10. For entry and/or exit outside the entry and exit hours specified in the advertisements, the customer must confirm with the holiday boat owner.

11. V-Go Yachting cannot be held responsible for any problems arising from the customer not being able to enter the holiday boat if the customer arrives after the time stated in the advertisement and/or confirmed with the holiday boat owner. The customer must find the holiday boat himself.

12. Any problems, damages, grievances, etc. arising from the customer's failure to unload the holiday boat before the time stated in the advertisement and/or confirmed with the holiday boat owner. The customer is responsible for all negativities and the customer is obliged to cover any financial damages that V-Go Yachting may incur due to these negativities.

13. If the customer voluntarily leaves the holiday boat earlier than the booked departure date, no refund will be made to the customer for the accommodation fee.

Holiday Boat Capacities

14. Guests, including children and infants, exceeding the capacity stated in our advertisements or the number of people specified when making the reservation are strictly not accepted on our holiday boats.

15. If the customer wishes to make a change in the number of people after the reservation is finalized, he/she must apply in writing via V-Go Yachting WhatsApp line and the capacity status of the holiday boat will be checked and if the holiday boat owner and V-Go Yachting deem it appropriate, this change can be approved. If holiday boat owners request additional fees for subsequent changes in the number of people, this information will be shared with the customer by V-Go Yachting.

16. After entering the holiday boat, no guests other than those specified in the reservation list are strictly accepted on the holiday boat. In cases where the contrary is determined, the holiday boat owner and/or V-Go Yachting may request the guests to leave the holiday boat, cancel the reservation completely or request that the holiday boat be completely evacuated without waiting for the end of the rental period, not refund if the full fee has been received, or request the remaining payment if not. has the right.

17. During the rental phase of the holiday boat, the transaction is carried out in line with the customer's declaration, and the customer accepts that the information provided is correct and complete and accepts all responsibilities arising in this regard.

18. When entering the holiday boat, photocopies of the identity cards of all our guests or their photos via WhatsApp are requested by our holiday boat owner and the guests are entered into the Gendarmerie Identity Notification system.

Alcohol and Cigarette Use

19. Smoking is not allowed in the indoor areas of all our holiday boats. If smoking is detected in closed areas, the holiday boat owner has the right to deduct the deposit.

20. Alcohol consumption is not allowed on all of our holiday boats. The information of those who do not give permission is written in the details of our advertisements.

Damage Deposit

21. A different amount of damage deposit will be collected from the customer for each holiday boat, depending on its characteristics. Deposit amounts are included in holiday boat advertisements and reservation forms sent to the customer.

22. The damage deposit will be collected from the customer in cash on the day of entry to the holiday boat, and in the control to be made before the customer leaves the holiday boat, there will be no damage, missing etc. to the holiday boat delivered in good condition and the fixtures of the holiday boat. If not, it will be refunded in cash without interruption. Damage, missing etc. In case of damage, the damage will be determined and the amount to repair the damage will be deducted from the deposit and the deposit will be refunded. In case of damages and/or deficiencies that cannot be covered by the deposit received, the remaining amount will be requested from the customer, and if the customer does not pay, legal action will be taken.

23. If the customer leaves the holiday boat before the time confirmed with the holiday boat owner, the damage will be checked later and the deposit refund will be taken from the customer and sent to an account number. Shipping costs will be paid out of the damage deposit.

Cancellation Conditions and Refund Conditions

24. In case of cancellations made by the customer, the prepayment received will not be refunded to the customer, regardless of the channel made and the cost.

25. Cancellation and refund conditions are chosen by the holiday boat owner differently for each listing, and for all cancellation and refund conditions, please refer to the "Cancellation and Refund Conditions" section of our website. page can be visited.

26. If, for any reason, the holiday boat reservation is canceled by V-Go Yachting, the customer will be notified as soon as possible. If there is an equivalent holiday boat in our portfolio that is available for the same dates, it will be offered to the customer. In cases where the customer does not approve and does not fall under the "force majeure" clause, the money received will be refunded to the customer without interruption.

27. Reservation cancellation requests can be made in writing via email or our WhatsApp line. Reservation cancellations made by phone are not valid. Reservation cancellations will be evaluated as soon as the request is notified in writing to the V-Go Yachting WhatsApp line.

28. V-Go Yachting cannot be held responsible for the non-use of the holiday boat, including cases of termination of the contract due to a reason arising from the customer's fault or without duly written notice, provided that this contract is valid from the reservation confirmation with the express declaration of the parties. The entire price shown in the contract becomes due on the agreed delivery date of the holiday boat, and V-Go Yachting reserves all legal rights in this regard.

Our Responsibilities and Warranty

29. V-Go Yachting is responsible for monitoring the delivery of the holiday boat to the customer on the specified date and time.

30. V-Go Yachting acts as an intermediary between the customer and the holiday boat owner. For this reason, the holiday boat owner is responsible for eliminating any problems that may occur on the holiday boat. V-Go Yachting is not responsible for resolving these malfunctions; it assists the customer and/or the holiday boat owner in resolving the malfunctions.

31. Apart from this, any accident, disease, injury, drowning, death, theft, etc. that may occur and are the customers' own responsibility. and fire, theft, etc. that may occur on the holiday boat. V-Go Yachting cannot be held responsible for incidents and accidents.

32. Excursions, shopping, food, beverages, entertainment, transportation, travel, guidance services, etc. that the customer will receive from third parties/companies during the customer's arrival to the holiday boat, their return, and during the holiday. V-Go Yachting cannot be held responsible for any problems arising from any service such as.

33. After leaving the holiday boat, the customer cannot claim any right or refund for a service that he did not receive due to a malfunction or malfunction that he did not notify V-Go Yachting during his stay on the holiday boat.

34. The majority of the holiday boats published on the V-Go Yachting website do not belong to V-Go Yachting. The owners of each holiday boat are different people, individuals, institutions, companies.

35. V-Go Yachting is an intermediary (broker) for individuals, individuals, institutions, companies to rent a holiday boat to a customer. For this reason, V-Go Yachting only provides brokerage services.

Customer's Responsibilities

36. Customers are obliged to use the holiday boat, its furniture, all electrical and electronic equipment and other furniture delivered to them in working and sound condition in a clean manner.

37. Customers are obliged to leave all kitchenware delivered to them clean in the same way.

38. Any damage caused to the holiday boat by the customers during their stay and the cost of any belongings they lose will be deducted from this deposit, if a damage deposit has been received, and in cases of damage exceeding the damage deposit, the customer will be requested to pay in cash. Otherwise, legal action will be taken.

39. In addition, the customer and his/her entourage must be careful to comply with social and moral rules, not to make noise that will disturb the environment, not to listen to loud music, and not to engage in criminal behavior that is prohibited by the laws of our country. For such reasons, if V-Go Yachting and/or the holiday boat owner receives a complaint about the customer and his/her entourage, V-Go Yachting and/or the holiday boat owner has the right to ask the customer to vacate the holiday boat before the reservation period expires.

Force Majeure

40. In cases falling within the scope of force majeure, V-Go Yachting may terminate this agreement unilaterally without taking on any legal liability.

41. War in the region or country, threat of war, riots, strikes, terrorist activities, epidemics, technical problems that may occur in transportation, prohibitions of state authorities in the region that V-Go Yachting cannot prevent, and all events that cannot be predicted and develop beyond our control. Events will be considered within the scope of force majeure.

Security and Privacy Policy

42. V-Go Yachting will not disclose personal information to any company or third parties, except as defined in this Privacy Policy and the Rental Agreement.

43. V-Go Yachting will never sell the personal information of visitors, registered users and partners to third parties. (Personal information refers to any information intended to identify the user, such as name, surname, address, telephone number, e-mail address.)

44. V-Go Yachting may use personal information to determine user profiles and conduct statistical studies, and may share it with third parties only for the purpose of carrying out these studies.

45. V-Go Yachting undertakes to keep personal information strictly private and confidential, to consider this as a confidentiality obligation, to ensure and maintain confidentiality, and to take necessary measures to prevent all or any part of the confidential information from entering the public domain or unauthorized use or disclosure to a third party. undertakes to receive it and to show due care.

46. Other Important Information

47. V-Go Yachting cannot be held responsible if the different materials used in the construction of some of our holiday boats (cedar wood, pine wood, some plastic products, etc.) cause health and/or psychological discomfort to the customer.

48. The customer may obtain a taxi, transfer vehicle or rental car from third parties during the time on land. V-Go Yachting is not responsible for the transfer or taxi service rented or rented from third parties.

49. V-Go Yachting cannot be held responsible if the customer who has rented the holiday boat is dissatisfied with the locations visited by the rented holiday boat. The route of the holiday boat is stated by the advertiser on our website. Most advertisers leave the route choice to the customer within certain limits. Complete routes will be shared with customers by holiday boat owners.

50. V-Go Yachting cannot be held responsible for situations such as no or low mobile phone signal reception or lack of internet connection on the mobile phone at the sea, in the bays / islands where you will spend the night. It is recommended that you call your GSM operator and get detailed information about the GSM signal status in the region you will go to.

51. Credit card, mail order, EFT, money transfer, FAST etc. Even if you make payment via these methods, you will definitely not be able to pay for your flight ticket, bus ticket, etc. before you receive a "reservation confirmation email" in your e-mail address. Do not buy. If you do not receive the "reservation confirmation e-mail", you will not be considered to have completed the reservation or rented your holiday boat. V-Go Yachting cannot be held responsible for any material or moral damages that may arise from this and similar situations where the customer acts hastily.

52. V-Go Yachting cannot be held responsible for all accidents and incidents caused by the customer that may occur on the holiday boat and for the deaths and accidents that may occur as a result.

53. Photographs of all our holiday boats cannot be taken by V-Go Yachting. V-Go Yachting aims to make a business plan and revise the photo shoots of all holiday boats. However, since it will take time to complete the process, he prepares the advertisements by requesting photos of the holiday boats that he cannot take himself, from the holiday boat owner. Some shots, including V-Go Yachting shots, are taken with wide-angle professional lenses to show more details. For this reason, some objects may appear larger and wider in photographs than in reality. The customer must accept this situation. After entering the holiday boat, it cannot request to cancel the reservation by claiming that the holiday boat does not look as it does in the advertisement on the website, and V-Go Yachting cannot be held responsible for this situation.

54. V-Go Yachting cannot be held responsible for any negativities that may occur due to positive or negative natural events and conditions and positive or negative weather conditions.

55. It protects the customer from poisonous fish, bees, scorpions, insects, snake bites, cat and dog bites, etc. V-Go Yachting cannot be held responsible for the incidents.

56. V-Go Yachting cannot be held responsible for any illnesses that may occur at sea in the bays where the holiday boat is watching.

57. Funeral, death, war, health problem, accident, cancellation of leave of public personnel or private company personnel, etc. In such cases, the rental conditions remain the same and cancellation is unfortunately not possible.

58. The customer has accepted all the conditions we have stated above, and in case he tries to terminate the rental agreement by citing these and similar situations, V-Go Yachting can use his right to terminate the agreement on his own and the right to demand the contract fee.

59. Our customers who make a reservation on any of our holiday boats are deemed to have accepted all of the above items. In case of violation of any of these articles, V-Go Yachting has the right to unilaterally cancel the reservations, not to provide a refund, and to request any remaining payment. Otherwise, legal action may be taken.
